These Terms of Service ("Terms") govern your use of SpectoAI ("we," "us," or "our") and our BigCommerce application for AI-powered alt text generation ("Services").

By using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

Service Description

In Short: We provide AI-powered alt text generation for BigCommerce product images.

SpectoAI generates alternative text descriptions for your BigCommerce product images using artificial intelligence. Our service helps improve web accessibility and search engine optimization by creating descriptive text for images.

Eligibility

In Short: You must be 18+ with a valid BigCommerce store.

To use our Services, you must:

  • Be at least 18 years of age
  • Have a valid BigCommerce store
  • Be authorized to manage the store's content

Your Account

You are responsible for your BigCommerce account security and all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or use of your account.

Credits and Billing

In Short: 1 credit = 1 image. Subscription credits reset monthly. All fees are non-refundable.

Credit System

  • 1 credit = 1 image processed for alt text generation
  • Free Trial: 100 one-time credits that never expire
  • Subscriptions: Credits reset monthly on your billing date
  • Credit Packs: One-time purchases that never expire

Unused Credits

Subscription credits do not roll over to the next billing period. Credit Pack credits never expire.

Refund Policy

All fees are non-refundable. This includes subscription fees and Credit Pack purchases. You may cancel your subscription at any time, but no refunds will be provided for the current billing period.

Acceptable Use

In Short: Use our service responsibly and legally.

You agree NOT to:

  • Process images you do not have rights to use
  • Use the service for any illegal purpose
  • Attempt to circumvent usage limits or credits
  • Reverse engineer or attempt to extract our AI models or algorithms
  • Submit images containing illegal or prohibited content
  • Resell or sublicense access to our service without authorization
  • Interfere with or disrupt the service

AI-Generated Content

In Short: AI may make mistakes. You are responsible for reviewing content before publishing.

Accuracy Disclaimer

Alt text is generated by artificial intelligence and may contain errors, inaccuracies, or inappropriate content. We do not guarantee the accuracy or appropriateness of any generated content.

Your Responsibility

YOU ARE SOLELY RESPONSIBLE for:

  • Reviewing all generated alt text before applying to your store
  • Ensuring generated content is accurate and appropriate for your products
  • Compliance with accessibility standards in your jurisdiction (WCAG, ADA, EAA)
  • Any consequences of publishing AI-generated content

No Guarantee

We make no representations or warranties regarding accuracy of descriptions, suitability for any purpose, compliance with accessibility standards, or SEO improvements.

Intellectual Property

  • Our IP: We own the service, software, AI models, and all related technology
  • Your IP: You retain all rights to your product data, images, and store content
  • Generated Content: You may use AI-generated alt text for your business purposes without restriction

Service Availability

We strive for high availability but do not guarantee uninterrupted service.

  • Scheduled Maintenance: We will attempt to provide 24-hour notice
  • Modifications: We may modify, update, or discontinue features with reasonable notice
  • Dependencies: Service availability depends on BigCommerce API and AI provider availability

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI-GENERATED CONTENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless SpectoAI from any claims, damages, or expenses arising from:

  • Your use of AI-generated content
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you upload to our service

Termination

  • By You: Uninstall the app from BigCommerce at any time
  • By Us: We may terminate or suspend access for Terms violations
  • Data Deletion: Your data is deleted within 30 days of termination

Sections regarding intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.

Changes to Terms

We may update these Terms at any time. Material changes will be notified via email or in-app notification at least 30 days before taking effect. Continued use after changes take effect constitutes acceptance of the new Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles. Any disputes shall be resolved by the courts of competent jurisdiction in Poland. For EU consumers, this does not affect your right to bring proceedings in your country of residence.
