SpectoAI — Terms of Service

1) Parties and Acceptance

These Terms of Service ("Terms") govern access to and use of SpectoAI (the "Service"), a software-as-a-service application distributed through the Shopify App Store and accessed within the Shopify admin interface.

The Service is operated by GetRobo ("Company", "we", "us", "our").

By installing, accessing, or using the Service, you agree to these Terms on behalf of the business entity that owns or administers the Shopify store ("Customer", "you"). If you do not agree, do not install or use the Service.


2) Eligibility; Business Use Only

  • The Service is intended for business customers (B2B) only and is not directed to consumers.
  • You must be at least 18 years old and have authority to bind Customer.
  • You must have an active Shopify store to use the Service.

3) Definitions

  • "Shopify" means Shopify Inc. and its affiliates.
  • "Store" means your Shopify store instance.
  • "Shop Domain" means the unique identifier Shopify uses for a Store (e.g., mystore.myshopify.com).
  • "Product Data" means product-related information and image URLs obtained from Shopify APIs (e.g., titles, descriptions, vendor, product type, tags, image URLs, existing alt text).
  • "Alt Text" means alternative text associated with product images in your Store.
  • "AI Output" means Alt Text generated by the Service using third-party AI models.
  • "Credits" means the monthly or trial allowance used to generate AI Output (1 credit = 1 generated alt text).
  • "Auto-processing" means webhook-triggered generation for newly created products (available on certain plans).

4) The Service

4.1 What the Service Does

SpectoAI helps you generate Alt Text for product images to support accessibility and SEO. The Service:

  • reads Product Data from your Store via Shopify Admin APIs,
  • sends limited Product Data and image URLs to a third-party AI provider to generate AI Output,
  • displays AI Output for your review (and, if you choose, applies it to your Store via Shopify Admin APIs).

4.2 Review Requirement and AI Limitations

  • No guarantee of accuracy: AI Output may be incorrect, incomplete, or inappropriate.
  • You are responsible for review: Unless you enable Auto-processing, you are responsible for reviewing AI Output before applying it.
  • Auto-processing is optional and opt-in: If enabled, AI Output may be generated (and/or applied) automatically depending on your configuration; you remain responsible for the results.

4.3 No Customer/Payment Data from Your Shoppers

The Service is designed not to access or process your end-customer order, payment, or financial data. It focuses on Product Data only.


5) Installation, Access, and Security

  • Installation and authentication occur via Shopify's OAuth flow.
  • You are responsible for maintaining the confidentiality of your Store credentials and for all activity under your Store's access.
  • We may store Shopify access tokens securely to provide the Service and communicate with Shopify APIs.
  • You must notify us promptly of any suspected unauthorized use: contact@getrobo.xyz.

6) Subscriptions, Billing, Credits

6.1 Billing Through Shopify

Subscriptions, billing, and cancellations are handled via Shopify App Billing API. We do not directly process your credit card data.

6.2 Plans and Credits

  • Each plan includes a monthly allotment of Credits.
  • Credit usage: 1 Credit = 1 generated alt text (one AI analysis per image).
  • Rollover: Unused Credits roll over to the next month while your subscription remains active.
  • We may impose reasonable technical limits to prevent abuse (e.g., rate limits, concurrency caps).

6.3 Free Trial

If offered, Free Trial Credits are one-time and may be limited. Trial eligibility is determined at the time of app installation.

6.4 Price/Plan Changes

We may change plans, pricing, and included features from time to time. Where required, we will provide notice via the Service and/or email.


7) Refunds

Refunds (if any) are governed by Shopify's App Store policies and the billing relationship between you and Shopify. To the extent permitted, we disclaim any obligation to provide refunds outside of those policies.


8) Customer Responsibilities

You represent and warrant that:

  • You have all rights necessary to provide Product Data (including image URLs and associated content) for processing and to apply Alt Text to your Store.
  • Your use of the Service complies with applicable laws, including accessibility, advertising, and intellectual property laws.
  • You will not use the Service to generate content that is unlawful, deceptive, infringing, or violates third-party rights.

9) Acceptable Use

You will not:

  • attempt to interfere with or disrupt the Service (e.g., abuse rate limits, probe for vulnerabilities),
  • reverse engineer, copy, or create derivative works of the Service (except as permitted by law),
  • use the Service to process content that violates applicable law or Shopify's policies,
  • use the Service to generate content intended to mislead or deceive (e.g., false product claims).

10) Intellectual Property

10.1 Our IP

We retain all rights in the Service, including software, UI, branding, and underlying technology (excluding Customer's Product Data).

10.2 Your Data

As between the parties, Customer retains ownership of Product Data.

10.3 AI Output Ownership/License

To the extent permitted by law:

  • Customer may use AI Output in its business, including storing and displaying it in the Store.
  • We do not claim ownership of Customer's Product Data or AI Output, except that Customer grants us a limited license to process Product Data and generate AI Output solely to provide and improve the Service.

10.4 Feedback

If you provide feedback, you grant us a worldwide, perpetual right to use it without restriction or compensation.


11) Third-Party Services (Shopify, AI Providers, Hosting)

The Service relies on third parties, including:

  • Shopify (platform, OAuth, billing, webhooks),
  • AI model providers (for generation),
  • hosting/database providers.

Your use of Shopify is governed by your agreement with Shopify. We are not responsible for third-party services, outages, or changes in their APIs/policies, except to the extent required by law.


12) Privacy

Our handling of personal data is described in the SpectoAI Privacy Policy. The Privacy Policy is incorporated by reference into these Terms.


13) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

WE DO NOT GUARANTEE ANY SPECIFIC SEO OUTCOMES, ACCESSIBILITY COMPLIANCE RESULTS, OR SEARCH RANKING IMPROVEMENTS.


14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL.
  • OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT PAID BY CUSTOMER FOR THE SERVICE IN THE 3 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM (OR US$100 IF NO FEES WERE PAID).

Some jurisdictions do not allow certain limitations; in that case, limitations apply to the maximum extent permitted.


15) Indemnification

Customer will indemnify and hold harmless Company from claims arising out of:

  • Customer's Product Data, products, marketing claims, or Store content,
  • Customer's use of AI Output (including failure to review),
  • Customer's breach of these Terms or violation of law/third-party rights.

16) Suspension and Termination

16.1 Suspension

We may suspend access if we reasonably believe:

  • the Service is being misused,
  • your use poses security risk,
  • required by Shopify or law.

16.2 Termination by Customer

You may terminate by uninstalling the app from your Shopify admin.

16.3 Effect of Termination; Data Deletion

Upon uninstall:

  • access stops immediately,
  • we will delete Store-related data immediately via the app/uninstalled webhook and GDPR compliance webhooks.

17) Changes to These Terms

We may update these Terms. If changes are material, we will provide notice via the Service and/or email. Continued use after the effective date constitutes acceptance.


18) Governing Law; Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles.

Any disputes arising under these Terms shall be submitted to the exclusive jurisdiction of the competent courts in Poland. For EU consumers, this does not affect your right to bring proceedings in your country of residence.
